Information procedure in standardisation field within the European Union
Directive 98/34
Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 amended by the Directive 98/48/EC of the European Parliament and of the Council of 20 July 1998 stipulates the deployment of a procedure for the provision of information in the field of technical standards and regulations with a view to:
- create and maintain the transparency within the European Union;
- prevent the creation of new technical barriers to trade within the Internal Market;
- facilitate and accelerate the European standardization.
These directives were transposed in the national legislation by the Government Decision 1587/2002, replaced by the Government Decision 1016/2004.
Technical regulations
The Member States of the European Union have to inform the European Commission about all their projects in the field of technical regulations. The Commission immediately notifies the other
Member States of the draft and all documents which have been forwarded to it, in the frame of a procedure enabling them to make comments or may deliver a detailed opinion about the aspects that may lead to the creation of obstacles to trade. The Member State concerned shall take such comments into account as far as possible in the subsequent preparation of the technical regulation or, if necessary, informs the Commission upon the reasons for which a detailed opinion cannot be taken into consideration.
In accordance with GD1016/2004, the Ministry of Economy and Trade has already organised within its structure the Compartment for Information Exchange for the Technical Regulations.
Standards
In conformity with these directives, the standardization bodies from the Member States of the European Union send information on the new subjects for which these national bodies have decided, by including them in their standards programme, to prepare or amend a standard, unless it is an identical or equivalent transposition of an international or European standard. This information has to be sent to CEN (European Committee for Standardisation), CENELEC (European Committee for Electrotechnical Standardisation) or ETSI (European Telecommunications Standards Institute), which assure the information of the national standards bodies from the Member States as well as of the European Commission.
Pursuant to the provisions of the GD1016/2004, in ASRO was created the Centre for information exchange on standards, having the duty to assure the provision of information in the field of technical standards.
The provision of information stipulated by the GD1016/2004 should start at the date of Romania’s accession to the European Union, but ASRO, initially as an affiliate member and starting with 2006 as a member of the European standards bodies CEN and CENELEC, has received the notifications received by these bodies from their members before Romania’s accession to the EU.
Starting with June 2005, ASRO publishes the received notifications, continuing to do it as receiving the lists; this publication enables the economic operators as well as any other interested parties to be informed about the work of the standards bodies in the Member States of the EU.
